1. Terms and Conditions

  • 1.1.  The Terms and Conditions of Nuture 4 Wellbeing govern your use of our website, ​www.nurture4wellbeing.com​ (the ‘website’) and your use of Nurture 4 Wellbeing content or materials (‘us’, ‘we’, ‘our’, ‘Team Nurture’ or ‘Nurture 4 Wellbeing’). Please read these terms carefully as they affect your rights. If you do not agree to these Terms and Conditions, please do not register with us as a teacher or school, use the website, or purchase any subscription.
  • 1.2.  By accessing and viewing the website and using the online content and services you agree to be bound by these Terms and Conditions. If you do not wish to abide by these conditions, do not use the website, register with us as a teacher or school, or purchase any subscription.
  • 1.3.  The products and services available on the website are solely for the use of a school or other similar educational institution and individuals in the course of their teaching profession. The products and services are not for the use of consumers as defined in the Consumer Rights Act 2015.
  • 1.4.  You are also responsible for ensuring that all persons who access the website through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.
  • 1.5.  Please note that these Terms and Conditions may be revised from time to time. Any changes will be visible in new Terms and Conditions available on our website.
  • 1.6.  In registering as a user of the website, you confirm your acceptance of the Terms of Conditions of the website in full. If you do not accept any amendments made to the Terms and Conditions, you must contact us to cancel your subscription, for which cancellation regulations will apply. Previous terms and conditions will apply pending termination.

2. Subscription Materials

  • 2.1. The website provides a platform for schools to register their teachers for access to materials purchased through an annual subscription. Subscriptions begin in August each year and terminate in June. Materials are updated annually.

3. Cost

  • 3.1. Any member of the public can view the website free of charge. In order to become a member, you must choose your preferred plan(s) and subscribe. Payable fees are displayed with each plan on the website.

4. Content

  • 4.1.  All Nurture 4 Wellbeing Materials belong to Nurture 4 Wellbeing.
  • 4.2.  Subject to clause 4.6, you may display Nurture 4 Wellbeing Content on a computer screen or mobile device, electronic or interactive whiteboard, print on paper and store such pages in electronic form for your own personal, educational, non-commercial purposes.
  • 4.3.  Where you have a department/school subscription you may also use the Nurture 4 Wellbeing Content on your intranet or VLE provided each user of these systems has a personalised login, it is not open access and is restricted to teachers within the school subscribing to the service.
  • 4.4.  Most of the content on the website is owned by Nurture 4 Wellbeing, but at times we may have certain content under licence from third parties (‘third party content’) and will be marked with the copyright notice of those third parties. Some of the third party content will be subject to additional restrictions. The relevant copyright notice will make it clear where that is the case and you must comply with such restrictions. Every effort is made to trace all the copyright holders, but if any have been inadvertently overlooked, Nurture 4 Wellbeing will be pleased to make the necessary acknowledgments at the first opportunity.
  • 4.5.  Nurture 4 Wellbeing status (and that of any identified third party Contributors) as the authors of content on the Websites must always be acknowledged.
  • 4.6.  You may not (without prior written permission from Nurture 4 Wellbeing): 
    • i. redistribute, share or supply any of the content to other people or third parties who are not covered by the Subscription Service - any individual teaching outside of your School Wellbeing Department; 
    • ii. remove the copyright or trademark notice from any copies of content made under this agreement;
    • iii. create a database in electronic or structured manual form by systematically downloading and storing all or any of the content;
    • iv. except as expressly set out above, modify, reproduce or in any way commercially exploit any of the content.

5. Subscription

  • 5.1.  When you register your school, we will ask that you provide certain information including but not limited to your name, email address, school name, school postal address, and your payment details. Any personal or school information you provide to us with will be handled in line with our Privacy and Data Protection Policy.
  • 5.2.  On registration you will be required to create a password. You must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password, please change it immediately. You agree that all personal information that you supply to us will be accurate, complete and kept up to date at all times. We may use the information provided to us to contact you.
  • 5.3.  We will try to process your subscription promptly but this does not guarantee that any Membership Service will be available to you by any specified time.
  • 5.4.  Each Membership Service is solely for use by registered users. Nurture 4 Wellbeing reserves the right to monitor usage of the Membership Services using your ID.
  • 5.5.  Nurture 4 Wellbeing may terminate access to its Membership Services if it discontinues a service, in which case it will give you such notice as is reasonably practicable and you are entitled to a refund of that part of any fee which relates to the unexpired period of the relevant service.
  • 5.6.  Payments for Subscription Services are by credit/debit card and subject to auto-renewal. Alternatively, Nurture 4 Wellbeing will accept purchase orders for invoicing, and will notify the subscriber when their subscription is due for renewal. Further details are available upon subscription.
  • 5.7.  You must inform Nurture 4 Wellbeing of any changes to your email address. Failure to do so may result in you not receiving important information such as an auto renewal notification.

6. Competitions

  • 6.1. Any competition or prize draw promoted by Nurture 4 Wellbeing will set out clearly the requirements as to who is eligible to participate, how to participate and the closing date for entries. Entries not meeting the requirements published at the time of the promotion will not be valid.

7. Cancellation

  • 7.1.  Payments for Subscription Services are by credit/debit card and subject to auto-renewal. If you wish to cancel your subscription for subsequent academic years, please let us know by emailing us at nurture4wellbeing@gmail.com​. Please provide full details of your account and reason to cancel.

8. Intellectual Property

  • 8.1.  The content of the website is protected by Irish and international copyright and we reserve all rights in relation to our copyright.
  • 8.2.  This website or any portion of this website may not be reproduced, duplicated, copied, sold, resold, shared with other schools or otherwise exploited for any commercial purpose without our express written consent.
  • 8.3.  You may not systematically extract and/or re-utilise parts of the contents of the website without our written consent.
  • 8.4.  In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of the website without our express written consent.

9. Technology

  • 9.1.  Although we aim to offer you the best service possible, we make no promise that the website or contents will meet all of your requirements. We cannot guarantee that the website will be fault-free. If a fault occurs with the website, we ask that you report it to us immediately.
  • 9.2.  Your access to the website may be occasionally restricted to allow for repairs, maintenance or the addition of new content or for reasons beyond our control. In this event, we will endeavour to restore the service as soon as we can. Any such restrictions or interruptions shall not constitute a breach by us of these terms.
  • 9.3.  You must not misuse the website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the website, the server on which the website is stored or any server, computer or database connected to the website. You must not attack the website via a denial-of-service attack or a distributed denial-of service attack.

10. Our Liability

  • 10.1.  Team Nurture takes no responsibility for your school planning, execution of your lessons or performance in any aspects of evaluation, including but not limited to school-based inspections, Subject Department inspections and Whole School Evaluations.
  • 10.2.  We will not be liable for any loss or damage caused by viruses, a distributed denial-of-service attack or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the website or to your downloading of any material posted on it, or on any website linked to it.
  • 10.3.  Nurture 4 Wellbeing is not responsible for and will accept no liability for the content of external third party websites including (but not limited to) any such websites which are linked to from the website.
  • 10.4.  No assurances are given that the pages of the website are free from infection from computer viruses, although we take reasonable steps to prevent such infection.
  • 10.5.  Nurture 4 Wellbeing will use reasonable endeavours to verify the accuracy of any information on the website and all content but makes no representation or warranty of any kind, express or implied, statutory or otherwise regarding the contents, relevance or accuracy of the website or Nurture 4 Wellbeing materials.
  • 10.6. Nothing in these Terms and Conditions seeks to exclude or limit in any way our potential liability:
    • for death or personal injury caused by our negligence;
    • for fraud or fraudulent misrepresentation; or
    • for any matter for which it would be illegal for Nurture 4 Wellbeing to exclude, or attempt to exclude, its liability.

11. Indemnity

  • 11.1. You agree to fully indemnify and to keep Nurture 4 Wellbeing indemnified from and against any costs, claims, demands, expenses and liabilities suffered by Nurture 4 Wellbeing arising from or which are directly or indirectly related to your access to and/or use of the website or Nurture 4 Wellbeing materials in breach of these Terms and Conditions and any such access and/or use by any person (including, without limitation, a user) who is authorised by and/or who represents you.

12. Applicable Law and Jurisdiction

  • 12.1.  These Terms and Conditions are governed and will be interpreted in accordance with Irish law.
  • 12.2.  The Irish courts shall have non-exclusive jurisdiction to settle any claim or dispute which might arise out of or in connection with these Terms and Conditions.
  • 12.3.  If any part of the Terms and Conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part shall be severed from the remainder of the Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by applicable law.

13. Privacy and Data Protection

  • 13.1. You agree that any and all personal information and data collected from you via this website or as part of the services from time to time may be used in accordance with the Nurture 4 Wellbeing current ​Privacy Statement​. The statement also sets out our commitment to protecting your personal information and provides guidance on your rights under the Data Protection Act 2018.
  • 13.2. You warrant that the personal information you provide to us is true, accurate and complete in all respects and you will notify us immediately if there is any change in the personal information that you have supplied to us.

14. General Information

  • 14.1.  You may not assign or subcontract any of your rights or obligations under these Terms and Conditions to any third party unless agreed upon in writing by Nurture 4 Wellbeing.
  • 14.2.  We reserve the right to transfer or assign all or any of its rights, duties and responsibilities set out in the Terms and Conditions to another party.
  • 14.3.  Headings have been included for convenience only and will not be used in construing any provision of the Terms and Conditions.
  • 14.4.  No delay or failure by Nurture 4 Wellbeing to exercise any powers, rights or remedies under these Terms and Conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies include any other or further exercise of them.
  • 14.5.  These Terms and Conditions, and any additional terms and conditions referred to herein, contain the whole agreement between the parties relating to the use of the Websites and supersede all previous agreements between the parties relating to the Websites.
  • 14.6.  These conditions are governed by and construed and interpreted in accordance with the laws of Ireland. The User and Nurture 4 Wellbeing, agree to submit to the exclusive jurisdiction of the courts of Ireland. The place of performance of this Agreement shall be Ireland.
  • 14.7.  If you breach these Terms of Use and we decide to take no action or neglect to do so, then we will still be entitled to take action and enforce our rights and remedies for any other breach.
  • 14.8.  We will not be responsible for any breach of these Terms of Use caused by circumstances beyond our reasonable control. We may make changes to the format of the website at any time without notice.

15. Withdrawal of Access

  • 15.1.  Nurture 4 Wellbeing reserves the right to suspend or withdraw your login access at any time without notice and at its sole discretion pending investigation where it has reason to believe that such login ID details have been discovered and/or used by any person or organisation other than an authorised User of our Membership Services.
  • 15.2.  In the event that unauthorised users are accessing any Subscription Service using your ID, or you are found to be in breach of these Terms and Conditions, we may withdraw login access by giving notice to you and your school, and in such case Nurture 4 Wellbeing is not obliged to refund you any fees for Subscription Services.
